Apostille Review for Wills and Trust Documents

A will, a trust instrument and a court-certified probate record are not interchangeable. Start with the exact document requested by the overseas recipient.

Can my will or trust document receive an apostille?

Eligibility must be reviewed for the particular document and its certification. The title alone is not enough to confirm a route. Tell us whether you have an executed private instrument, a notarized document or a court-certified record, and where it was signed or issued.

Our team provides administrative review; the competent authority determines whether it can issue an apostille. The receiving organization determines its acceptance requirements.

Which version should I provide?

Ask the recipient and your attorney whether they require the original instrument, a permitted certified copy, a court record or another specified document. Do not substitute an ordinary photocopy or add a notarial certificate to an executed instrument without appropriate guidance.

Florida distinguishes eligible notarized documents from certified public records. Documents filed in court cannot simply be replaced by a Florida notary’s attested photocopy.

Does an apostille make a will or trust valid abroad?

No. Do not treat document authentication as a legal opinion on the instrument, its execution or its effect in another country. Consult qualified legal counsel about those questions. Our private coordination service does not include drafting, amending or interpreting wills and trusts.

What information is needed for an initial review?

  • The document’s title and the type of version available.
  • The state or territory of notarization, or the issuing court.
  • The receiving country and institution’s instructions.
  • Any requested translation and your deadline.

Start with a description. Do not enter beneficiary details, account numbers or the complete instrument in the general inquiry form. Ask for document-delivery instructions after the initial review.

What if my request includes other estate records?

Use our estate document review overview to organize powers of attorney, death certificates and court records alongside the will or trust request. Separate jurisdictions and document preparation can affect the estimate and delivery plan.
