Who can apostille a U.S. federal court document?

The HCCH list of U.S. competent authorities identifies clerks and deputy clerks of U.S. federal courts as authorities that issue apostilles on documents issued by those courts. Begin by confirming the issuing court’s instructions and the certified version it requires.

Do not assume a Florida state apostille is the correct route merely because the federal court is located in Florida.

What should I ask the issuing court?

Identify the exact record, case and overseas use. Ask the clerk’s office about a certified copy and the apostille procedure applicable to that record. A downloaded docket entry is not automatically the certified document required for international use.

For example, the Western District of Michigan describes its apostille as authenticating the court certification signature and seal. That court’s procedure is an example, not a universal set of instructions for every federal court.

Are an exemplification and an apostille the same request?

Do not assume they are interchangeable. Tell the clerk the destination country and provide the recipient’s exact request. Confirm the certification needed before paying for or ordering a particular version.
